I. GENERAL PROVISIONS

A User is a natural person using the website https://tuatarautv.eu/.
The Administrator, in accordance with the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (hereinafter referred to as the “GDPR”), fully respects and recognizes the Users’ right to privacy and protection of personal data, and thus processes necessary Personal Data in accordance with the GDPR, the Personal Data Protection Act of May 10, 2018 (Journal of Laws 2018, item 1000), the Act on Electronic Service Provision of July 18, 2002 (Journal of Laws No. 144, item 1204, as amended), and the Telecommunications Law of July 16, 2004 (consolidated text, Journal of Laws 2017, item 1907, as amended).
This Privacy Policy aims to generally describe how and to what extent Users’ Personal Data is collected, the purposes for which this Data is used, to whom it is disclosed, and how it is protected. In the Privacy Policy, Users will also find information on their rights under the applicable personal data protection laws.
This policy is general in nature and presents the most important issues related to the processing of personal data. It is complemented by specific regulations or information clauses that the User will receive when their personal data is collected for specific services, such as Newsletter subscription, contact forms (scheduling a test drive, request for contact, or inquiry form).
The Administrator applies all available technical and organizational measures to ensure the protection of Users’ personal data processed in a manner appropriate to the risks and the category of data being protected, particularly by securing the data from unauthorized access, theft, unlawful processing, alteration, loss, damage, or destruction.
The Personal Data provided by the User on the Zefir UTV website is encrypted and protected using an SSL certificate.

II. PURPOSE AND SCOPE OF DATA COLLECTION

1. Personal Data collected by the Administrator is used solely for the following purposes:

a. responding to User inquiries via email or phone contact – the legal basis for these actions is the processing of data necessary to take action at the request of the data subject,

b. marketing purposes – with the explicit consent of the User – in accordance with Article 6(1)(f) of the GDPR,

c. scheduling a test drive or responding to User inquiries and complaints using contact forms, which serves the legitimate interest of both parties – the User and the Service Administrator,

d. preparing a commercial offer related to the activities of Zefir UTV Limited Liability Company, sending Newsletters, and carrying out marketing campaigns, which serves the legitimate interest of Zefir UTV. Such information is sent based on the User’s consent for electronic or telephone communication,

e. for the purposes and to the extent necessary to establish, pursue, or defend Zefir UTV’s claims related to the use of the www.tuatarautv.eu website, which serves the legitimate interest of Zefir UTV,

f. for the conclusion and performance of sales agreements or preliminary sales agreements with the User, related to the registration of the User.

2. Providing personal data mentioned in point b is voluntary and requires the User’s consent and is necessary for submitting a service quotation electronically and contacting the User to respond to their inquiries electronically or by phone.

3. Users’ Personal Data will be stored by the Administrator for the following periods:

regarding data processed to respond via the contact form – until the correspondence is clearly closed by the Administrator or the User’s contact.
Data processed based on consent, i.e., data used to send marketing information, will be processed until consent is withdrawn.

4. Access to personal data is limited to our selected employees and employees of trusted subcontractors, whose services we use to maintain the functionality of the Website, and who are obliged to keep the obtained information strictly confidential.

III. USER RIGHTS REGARDING THE PROCESSING OF PERSONAL DATA

Providing personal data by the User is entirely voluntary. However, failure to provide personal data prevents contact with the User and restricts the User from using certain services offered on the Website.
The processing of the User’s personal data for marketing purposes is based on the User’s voluntary consent. The User may withdraw their consent at any time by contacting the Administrator via email at: office@tuatarautv.pl. Withdrawal of consent does not affect the legality of the data processing that took place before the withdrawal.
Users have the right at any time to find out whether their Personal Data is or has been stored and to consult with the Data Administrator to learn about its content and origin.
By providing their Personal Data through the Zefir UTV Website, the User has the right to control the processing of data, access their data, rectify, correct, supplement, update, temporarily or permanently suspend processing, delete, restrict processing, object to processing, and transfer the data.
The User may exercise the above rights by sending an appropriate email to the Administrator’s address: office@tuatarautv.pl.
In case of violations concerning the data processing process, complaints should be submitted to the supervisory authority, which is the General Inspector for Personal Data Protection (address: General Inspector for Personal Data Protection, ul. Stawki 2, 00-193 Warsaw).

IV. DATA STORAGE PERIOD

Data is stored for the period necessary to provide the service requested by the User or for the period specified by the purposes described in this document. The User may always request the Data Administrator to suspend or delete the data. Personal Data used for marketing purposes is stored until the User objects to its processing for marketing purposes or withdraws their consent. Data related to handling User requests as a Zefir UTV Client submitted online is stored until the statute of limitations for claims arising from the contract between the User and Zefir UTV expires. In case of potential claims related to the use of the Website, Data is stored until the expiration of those claims.

V. TYPES OF DATA COLLECTED

Personal Data is collected only to the minimal extent necessary to achieve the purposes for which it is collected. Users’ data is protected against loss, unauthorized access, accidental loss or alteration, and other unlawful forms of processing. When Personal Data is shared with other entities, this is done in a secure manner, contractually protected and in accordance with applicable law. The retention of personal data is compliant with the law, limited to the period necessary to achieve the purposes for which the Data is collected, unless there are events that necessitate extending the data retention period.
The Personal Data referred to in this Privacy Policy may include a range of data, depending on the category of data subject and the User’s status – whether they are already a Zefir UTV Client, a person interested in Zefir UTV products or services, as well as the purpose for which the Data is collected. Each time, only the necessary range of data is processed.
Among the personal data that may be processed are: identification data (name and surname), contact details (phone number, email address), location data, inquiry, order, and complaint data, product or service information that the User is interested in, information provided during conversations or contained in correspondence addressed to Zefir UTV (including on social media), and for business entities, also the company name and VAT number, contact person’s data (position), and data related to the use of chats.
Personal Data may be freely provided by the User or automatically collected during the use of the website. Any use of cookies – or other monitoring tools – by the website or by third-party service owners used by this website, unless stated otherwise, is for the purpose of identifying Users and remembering their preferences solely to provide the services required by the User. Failure to provide certain personal data may prevent the provision of services. The type of data required to process inquiries, orders, or test drive registrations is marked with a “*” symbol.
Zefir UTV collects Users’ Personal Data through the contact form on the Website, phone contact, Newsletter registration, inquiries or messages via social media.
When logging into online services using social network credentials, such as Facebook, Google+, or others, the User agrees to share their data. This also includes communication through the Facebook chat window (after logging in), placed directly on the pages. Data may include, for example, name and surname, email address, date and place of birth, location, and any information the User wishes to share.

VI. COOKIES FILES

The website https://tuatarautv.eu/ uses cookies. Not changing the browser settings on the User’s side is equivalent to consenting to their use.
Cookies (so-called “cookies”) are text files designed to collect standard information about logging into the Internet and the User’s behavior while visiting websites, which are stored on the User’s end device and intended for use on the website.
Only the Administrator has access to the cookies. The files do not contain Personal Data.
Two main types of cookies are used on the website https://tuatarautv.eu/: session cookies (“session”) and persistent cookies (“permanent”). “Session” cookies are temporary files stored on the User’s end device until leaving the website or turning off the web browser. “Permanent” cookies are stored on the User’s end device for the time specified in the cookies parameters or until they are deleted by the User.
The Administrator uses marketing tools such as Facebook Pixel to target ads to the User. Through these tools, we direct ads to you on Facebook. In this regard, the Administrator relies on a legitimate interest in marketing its services. For this purpose, the Administrator uses cookies from Facebook Inc., 1601 S. California Ave. Palo Alto, CA 94304, USA. As part of cookie settings, the User can decide whether they consent to the Administrator’s use of Facebook Pixel.
Facebook Pixel allows Facebook to identify individuals visiting https://tuatarautv.eu/ as a target group for displaying ads on Facebook. The Administrator uses Facebook Pixel to display its ad on Facebook to people registered on this social network who have shown interest in the services provided by the Administrator. The Administrator also uses Facebook Pixel to analyze the effectiveness of ads on Facebook for statistical purposes. Facebook Pixel establishes a direct connection with Facebook’s servers during the User’s visit to the site https://tuatarautv.eu/. The information thus collected is transmitted to the Facebook server in the United States and stored there. The information collected within Facebook Pixel is anonymous, meaning that it does not allow the Administrator to determine the identity.
The Administrator uses cookies to track website statistics, such as the number of visitors, the type of web browser used for viewing websites, the time spent on the website, visited subpages, etc. In this regard, the Administrator uses Google Analytics, utilizing cookies from Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA. The Administrator relies on a legitimate interest in marketing its services. The User, within the mechanism for managing cookie settings, has the ability to decide whether the Administrator will use marketing tools as part of the Google Analytics service or not.

VIII. METHODS OF PROCESSING

The Data Administrator processes the Users’ Data correctly and takes appropriate security measures to protect against unauthorized access, disclosure, modification, or unauthorized destruction of data. 

The Administrator takes special care to protect the interests of individuals to whom the Data relates and ensures, in particular, that the Data it collects:

is processed lawfully, fairly, and transparently for the person to whom the Data pertains,
is collected for specific, explicit, and legitimate purposes and not further processed in a manner incompatible with those purposes,
is accurate and, where necessary, kept up to date,
is stored in a form that allows identification of the person to whom the Data pertains for no longer than necessary for the purposes for which the Data is processed,
is processed in a manner that ensures appropriate security of Personal Data, including protection against unauthorized or unlawful processing and accidental loss, destruction, or damage, using appropriate technical or organizational measures.

The Administrator continuously conducts risk analysis to ensure that Personal Data is processed securely – ensuring, above all, that only authorized persons have access to the data and only to the extent necessary for their tasks. The Administrator ensures that all operations on personal data are recorded and performed only by authorized employees and collaborators. The Administrator takes all necessary steps to ensure that its subcontractors and other cooperating entities also provide guarantees of using appropriate security measures whenever they process Personal Data on behalf of the Administrator.

Data processing is carried out using computers and/or IT tools, in accordance with organizational procedures and methods strictly related to the specified purposes. In addition to the Data Administrator, in some cases, the Data may be accessible to certain types of persons responsible for running the service (administration, sales, marketing, legal system, system administration) or external entities (such as providers of technical services, marketing services, market research, event organization and execution, call centers, transport, archiving, correspondence handling, postmen, couriers (in connection with order fulfillment), courier companies, hosting providers, IT companies, communication and marketing agencies, banks and payment operators, accounting service providers, legal services, auditing services, consulting services, professional advisors), appointed, if necessary, as Data Processors by the Owner. The current list of these parties can be obtained from the Data Administrator at any time. In some cases, external entities providing services on our behalf may act as independent data controllers, such as the Polish Post or other postal operators, payment transaction operators.

The Administrator reserves the right to disclose selected User information to the appropriate authorities or third parties who request such information, relying on the appropriate legal basis and in accordance with the provisions of applicable law.

For future marketing purposes, the recipients of the User’s Personal Data as Data Processors may be Authorized Dealers or Authorized Service Partners of the Zefir brand, also acting on behalf of and for Zefir UTV Spółka z o.o.

It should be emphasized that in cases where data recipients independently and on their own behalf process Personal Data from the User, e.g., offer products and services through their own channels without the involvement of Zefir UTV or perform services on their own behalf, they will become independent data controllers and, in this respect, will bear their own responsibility for processing such personal data, not being subject to the conditions of this Privacy Policy.

The service may contain links to other websites, social media sites, or to websites of cooperating entities, financial institutions. When navigating to a third-party website, Users will be subject to a separate privacy policy and data protection applicable to that website. You should familiarize yourself with the privacy policy and data protection of each website.

IX. WITHDRAWAL OF CONSENT

In the case of processing Users’ Personal Data related to the provision of data in connection with an inquiry about an offer, a test drive, or a service visit, the User can withdraw their consent at any time by informing Zefir UTV of their desire to discontinue contact via e-mail: office@tuatarautv.pl (losing interest in the offer, test drive, or service visit will be equivalent to the User withdrawing their consent). For Users, Clients, or Potential Clients of the Zefir brand, withdrawal of consent for future marketing purposes can also occur at any time by contacting via e-mail: office@tuatarautv.pl.

Withdrawing consent does not entail any negative consequences. However, the User must be aware that withdrawing consent will result in the inability to use services such as receiving responses, offers or advertisements, invitations to events for which the law requires Zefir UTV to obtain User consent.

The request to withdraw consent will be processed immediately. Once the request is fulfilled, processing of personal data for marketing purposes will cease, including the receipt of marketing and commercial information via electronic means and by phone. However, until the request is fulfilled, it may happen that the User receives information from which they opted out by withdrawing consent due to the time required to implement the request in the systems.

If Zefir UTV possesses User Data for the purposes of fulfilling other objectives (e.g., fulfilling a contract, providing services, proving evidence, pursuing claims), it may continue processing the data for these purposes under a different legal basis.

X. TRANSFER OF DATA OUTSIDE EEA

The level of protection for personal data outside the European Economic Area (EEA) differs from that provided by European law. For this reason, the Administrator only transfers Personal Data outside the EEA when necessary and with the assurance of an appropriate level of protection, primarily through:

cooperation with data processors in countries for which a relevant decision has been issued by the European Commission,
using standard contractual clauses issued by the European Commission,
applying binding corporate rules approved by the relevant supervisory authority,
in case of transferring data to the USA – cooperating with entities participating in the Privacy Shield program, approved by the European Commission’s decision.

The Administrator always informs about the intention to transfer personal data outside the EEA at the stage of data collection.

XI. USE OF COLLECTED DATA

User data is collected to enable the provision of services, as well as for the following purposes: analytics, further information about Personal Data, social functions, interactions with external networks and social platforms, contact with the User, advertising, remarketing, and behavioral targeting, email management, and sending messages.

For example:

Customer Personal Data may be processed to grant, present, or offer them dedicated offers and promotions, as closely tailored to their preferences as possible (which may have a significant impact on them) only if the Customer has consented to it (not available for those who have not given such consent).
